Because it isn't being presented as a mere "here is an interesting fact about what happened during that appointment." The whole bit at the end about why didn't Tribe race to resend his advice is clearly meant to convey the message: and here is why you should think less of Sotomayor.

And that is a bad argument because we now have plenty of actual opinions from here which are more than sufficient to condition away any influence a guess about her before confirmation should have.

I don’t agree. It’s of historical interest. It’s especially interesting that Tribe lied about his genuine opinion. Doesn’t that make Tribe look like a creep?

I thought this was very interesting and relevant. I am a conservative who has always considered Elena Kagan highly intelligent and capable even when I did not agree with her. I have also always considered Sotomayor dumber than a bag of hammers. So the backstory is fascinating.

C'mon, we all know Tribe is doing exactly what he should do and any of us would do if some advice we gave to a friend about another friend got leaked after the deciscion was made. NOT saying that would be a dick move. So what is your point?

We all can imagine being asked to recommend between multiple people we know and making our best candid estimate but not meaning to have that estimate turned into an attack or way to discredit those we didn't pick.

I mean yes, I would also agree she wasn't the most academically gifted jurist to pick. So what? That doesn't mean she isn't still very smart and able to do her job well or even that Obama should have selected otherwise. Intellectual power isn't the only important consideration here.

I mean, I think it is a problem that a known narcissitic moron like Sotomayor was chosen because she continues to sit on the bench. And we should understand how that happened.

Just an opinion. And since it began with Obama being the most impressive student he’s ever worked with (and ps manages to run for president) I’m sort of yawning here

Tribe has clearly lost his mooring! He’s not the first and unlikely to be the last asshole who has used his credentials to attack people more truthful and worthy of our trust. While this was certainly historically relevant, it’s mostly a reminder to judge even “experts “ by the contents of their character!

So, "deftly finessed" is yet another euphemism for "lied."
