I circulated earlier today a post (“The Unexplored Mystery Of How Stephen Breyer Became A Federal Judge”) about how Stephen Breyer was appointed to the First Circuit in 1980. I received information today that contradicts my inference that Senator Ted Kennedy was holding the seat in reserve for Breyer all along, so I have depublished the post.

The actual story that the new information tells is very interesting in its own way, but it’s materially different from what I posted. I will present it when I can.

My apologies, especially to Justice Breyer, for my error.
